Terms of Service

These Terms of Service ("Terms") govern your use of FIM One platform and related services provided by the FIM group of companies — comprising FIM Labs Pte. Ltd. ("FIM Labs," Singapore) and Beijing FIM Network Technology Co., Ltd. ("FIM China"), collectively "FIM," "we," "us," or "our." This includes the FIM One open source software, cloud-hosted services, commercial editions, website, documentation, and support services. By accessing or using our services, you agree to be bound by these Terms. The specific FIM entity that contracts with you, and the governing law applicable to these Terms, depend on your location. Please refer to the "Contracting Entity & Governing Law" section below.

The FIM entity that enters into these Terms with you, and the law governing these Terms, are determined by your location or domicile: • If you are located or domiciled outside of Mainland China (including Singapore, Southeast Asia, the European Economic Area, the United Kingdom, the United States, and other jurisdictions): – Contracting Entity: FIM Labs Pte. Ltd. ("FIM Labs"), 68 Circular Road, #02-01, Singapore 049422. – Governing Law: The laws of the Republic of Singapore, without regard to conflict-of-laws principles. – Dispute Resolution: Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the SIAC Arbitration Rules in force at the time, which rules are deemed to be incorporated by reference into this clause. The seat of the arbitration shall be Singapore. The tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English. • If you are located or domiciled in Mainland China: – Contracting Entity: Beijing FIM Network Technology Co., Ltd. ("FIM China"), T3-2112, Damei Center, Chaoyang District, Beijing. – Governing Law: The laws of the People's Republic of China. – Dispute Resolution: Any disputes arising from these Terms shall be submitted to the competent People's Court at the registered domicile of FIM China in Beijing. References to "FIM," "we," "us," or "our" in these Terms mean the applicable contracting entity as determined above.

By accessing or using our services, you agree to these Terms. You must: • Be at least 18 years old or have legal authorization to enter into agreements on behalf of an organization • Provide accurate registration information • Use the services in compliance with applicable laws and regulations • Not use the services for any illegal, harmful, or abusive purposes • Not attempt to gain unauthorized access to our systems or other users' data You are responsible for maintaining the security of your account credentials and are liable for all activities that occur under your account.

FIM One source code is released under a Source Available license. The specific license terms are detailed in the LICENSE file in our GitHub repository. Key terms include: • Internal commercial use is permitted • Modification and customization are permitted • The software may not be used to build multi-tenant SaaS platforms or directly competing Agent platforms FIM, FIM One names, logos, and related trademarks are the exclusive property of the FIM group of companies (FIM Labs Pte. Ltd. and Beijing FIM Network Technology Co., Ltd.) and may not be used without prior written consent.

AI-Generated Content: FIM One facilitates interaction between large language models (LLMs) and enterprise systems. AI-generated content, analyses, and recommendations are for reference only and should not be treated as professional legal, medical, financial, or other specialist advice. Users are responsible for verifying the accuracy of AI outputs before acting upon them. Third-Party Services: FIM One integrates with third-party LLM providers and enterprise systems. We are not responsible for the availability, accuracy, or security of third-party services. Your use of third-party services is governed by their respective terms and conditions. The platform is provided "as is" without warranties of any kind, either express or implied, for the open source edition.

Your data belongs to you. All data you input, upload, or generate through a self-hosted FIM One deployment remains yours. We do not claim ownership of your business data, documents, conversations, or knowledge base content. We do not access, collect, or transmit any data from self-hosted instances. For cloud-hosted or managed services, your data is securely stored and processed solely to provide the contracted services. Upon service termination, your data will be returned or deleted at your request. For details on how we handle personal data, please refer to our Privacy Policy. Our Privacy Policy governs all aspects of data collection, processing, storage, and protection across our services.

We strive to maintain continuous service availability but cannot guarantee uninterrupted access. Services may be temporarily unavailable due to: • Scheduled maintenance (with advance notice when possible) • Emergency security patches or necessary updates • Force majeure events (natural disasters, power outages, network failures, government actions) We shall not be liable for damages resulting from service interruptions beyond our reasonable control. For Enterprise edition clients, specific uptime guarantees are defined in the SLA agreement.

Community Edition: Free to use. FIM does not charge any fees. LLM API costs are not included and are paid directly to your chosen model provider. Commercial Editions (Professional/Enterprise): Pricing is customized based on deployment scale and required services. Payment terms, billing cycles, and refund policies are specified in individual service agreements. We reserve the right to modify pricing with reasonable advance notice.

You may stop using our services at any time. We may suspend or terminate your access to the services if you violate these Terms or engage in activities harmful to us or other users. Upon termination: • Your right to use the services ceases • You remain responsible for any outstanding payments • For commercial services, we will provide reasonable time for data export and migration • Provisions that by their nature should survive termination will continue to apply
